By accessing the website or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
You must be at least 18 years old, a resident of the United States, and able to form a binding contract to use the Services. Accounts are created only after you submit a sign-up request and our team completes its review, which may include identity verification and a discussion about your intended use of the Services. We may decline any request at our discretion.
Access to your account is authenticated using your email address and a one-time passcode (OTP) sent to that email. You are responsible for maintaining the security of your email account and for all activity that occurs under your account. Notify us immediately at support@transactionincoming.com of any unauthorized use. We will never ask you to disclose an OTP to any person.
You agree not to use the Services to: violate any U.S. federal, state, or local law; launder money or finance terrorism; transact with persons or jurisdictions subject to OFAC sanctions; commit fraud or deception; infringe intellectual property rights; interfere with the operation or security of the platform; or use the Services on behalf of an undisclosed third party.
The Services operate in compliance with the Bank Secrecy Act, USA PATRIOT Act, OFAC regulations, and applicable state money-transmitter requirements. You agree to provide truthful information and any documentation reasonably requested for identity verification or transaction review.
SMS messages are optional and sent only with your prior express consent. Message frequency varies. Message and data rates may apply. Consent to receive SMS messages is not a condition of purchasing or using any Service.
All content on the website — including the Transaction Incoming name, logo, text, graphics, and software — is our property or that of our licensors and is protected by U.S. copyright, trademark, and other laws. You receive a limited, non-exclusive, non-transferable license to access and use the website for its intended purpose.
THE WEBSITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRANSACTION INCOMING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE FEES YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Transaction Incoming, its officers, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or misuse of the Services.
Any dispute arising out of or relating to these Terms or the Services shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, conducted in Harris County, Texas, except that either party may bring an individual claim in small claims court. You and Transaction Incoming agree that each may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. You may opt out of this arbitration agreement by notifying us in writing within 30 days of first accepting these Terms.
These Terms are governed by the laws of the State of Texas and applicable federal law of the United States, without regard to conflict-of-law principles.
You consent to receive communications from us electronically, including emails and website postings, and agree that electronic communications satisfy any legal requirement that communications be in writing, in accordance with the federal E-SIGN Act.
We may suspend or terminate your access to the Services at any time for violation of these Terms, suspected fraud, or legal requirement. You may close your account at any time by contacting support. Provisions that by their nature should survive termination shall survive.
We may modify these Terms at any time. Material changes will be posted on this page with an updated effective date. Continued use of the Services after changes take effect constitutes acceptance.
